Arbitration
We act on a broad variety of domestic and international arbitrations, principally under the LCIA, ICC or UNCITRAL rules. We represent clients from many countries, both in international arbitrations in London, and in arbitrations in other jurisdictions which are subject to English law.
We have acted for clients based in many jurisdictions, and are therefore well versed in assisting non-UK clients in dealing with arbitrations under English law or subject to English procedural rules. Our corporate litigation team is also increasingly involved in transaction-related disputes in which the parties have chosen London as the seat of arbitration, despite no obvious connection with England for either the parties or the place of performance.
We have also undertaken High Court proceedings in support of or in relation to arbitrations.
We work closely with foreign law firms in assisting UK clients who are parties to international arbitrations in other jurisdictions.
Our excellent links with the London bar mean that we work with and are well known to many of the leading arbitrators and arbitration specialists in London.
Types of disputes upon which we have recently acted include:
- commercial contract disputes;
- complex and substantial oil and gas disputes;
- construction claims;
- engineering contracts;
One of our Directors Subir Karmakar is acting for clients who are pursuing claims worth millions of US dollars against sovereign states under arbitration provisions contained in bilateral investment treaties.
As the costs involved in pursuing such substantial and complex claims are normally quite large he has and will be happy to assist clients in obtaining third party funding for running the costs of merited claims and to secure cover for exposure to having to pay the opponent’s costs if and where necessary.
